These Terms of Service ("Terms") govern your access to and use of the Products and Services provided by Pivotfrag LLC ("Pivotfrag," "we," "us," or "our"). By accessing or using our Products, you agree to be bound by these Terms. If you do not agree, do not use our Products.
1. Description of Services
Pivotfrag provides consumer AI software applications, including but not limited to:
- SlidePilot: An AI-powered voice navigation tool for presentations.
- PulseMate: A personal health and emotion tracking companion with AI-powered insights.
Both Products are offered under a "freemium" model with a Free tier (limited features) and a Premium subscription (full features) at $4.99 per month per product. Pricing is subject to change with 30 days' notice to active subscribers.
2. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
3. Subscriptions & Billing
3.1 Free Tier. The Free tier is available at no cost with feature limitations as described on our Products page. No payment information is required.
3.2 Premium Subscription. Premium is billed at $4.99 per month per product. Payment is processed through a third-party payment processor. By subscribing, you authorize recurring charges until cancellation.
3.3 Free Trial. New Premium subscribers receive a 7-day free trial (SlidePilot) or 14-day free trial (PulseMate). No charges apply during the trial period. You may cancel anytime during the trial without charge.
3.4 Cancellation & Refunds. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Refund requests made within 14 days of a charge will be honored — no questions asked. Contact njh@pivotfrag.com.
4. Acceptable Use
You agree not to:
- Use the Products for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to reverse engineer, decompile, or extract the source code of our Products.
- Use the Products to transmit malware, spam, or any harmful or malicious content.
- Interfere with or disrupt the integrity or performance of our Products or infrastructure.
- Access or use the Products in any manner that could damage, disable, or impair our services.
5. Intellectual Property
Pivotfrag LLC owns all rights, title, and interest in and to the Products, including all associated intellectual property rights. These Terms do not grant you any rights to our trademarks, logos, or brand features. You retain full ownership of all data and content you create or input through our Products.
6. Health Disclaimer — PulseMate
⚠️ Important: PulseMate is a personal wellness companion and reflective tool. It is not a medical device, diagnostic tool, or substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information provided by PulseMate.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Pivotfrag LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Products. Our total liability for any claim arising from these Terms or your use of the Products shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Disclaimer of Warranties
The Products are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. We do not warrant that the Products will be uninterrupted, error-free, or completely secure.
9. Termination
We may suspend or terminate your account for violation of these Terms. You may terminate your account at any time through your account settings. Upon termination, your right to use the Products ceases immediately. We will retain your data for 30 days after termination to allow for export, after which it will be permanently deleted.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the federal or state courts located in Wyoming.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email and/or a prominent notice on our Site at least 14 days before the change becomes effective. Continued use after the effective date constitutes acceptance.
